What Everyone Ought to Know About Their First Amendment

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances

The 1st Amendment Contains 5 Individual Liberties!

  1. Freedom of Religion:  You have a right to practice any religion that you happen to choose and the government can do nothing to stop you.
  2. Freedom of Speech: The main point is that we don’t need a 1st amendment to protect popular speech (Texas v. Johnson 491 US 397 (1989)). Your 1st amendment free speech rights are there to protect  unpopular speech! Liberty cannot be preserved without the right to speak and speak those things that not everyone may want to hear!  The Supreme Court struck the ordinance down as unconstitutionally discriminating based on the content of expression. RAV v. St. Paul 505 US 377 (1992)
  3. Freedom of the Press: The Free Press Clause protects the right of individuals to express themselves through publication and dissemination of information, ideas and opinions without interference, constraint or prosecution by the government. You can start your own blog, your own radio show and you can use your 1st amemdment free speech rights to express yourself.
  4. Freedom to Assemble: You and you and your friends have a right to protest. In fact did you know that arresting peaceful protesters for disobeying order to leave is unconstitutional and police must protect protesters over safety of public.  The high court ruled that peaceful demonstrators may not be prosecuted for “disorderly conduct.” This case also secured streets and sidewalks as public forums. Hague v. C.I.O. (1939)
  5. Freedom to Redress the Government: The main point here is that you have a right to complain about the government – your government.

I am working on getting the proper contact to invite you as a speaker at the next Education Policy Conference sponsored by The Constitutional Coalition. They usually occur the last weekend in January here in St. Louis. Last January had over 400 attendees from about 30 states.     I don’t focus on memorizing “what me rights are” – I don’t play that game – because I have ALL RIGHTS as long as I do not agress upon another’s rights You name it and it is most likely a right….

    The Bill of Rights should be called the Bill of prohibitions against the government’s. Yes Government’s (plural). When the Several States signed onto the Constitution they also signed onto all of the restrictions & prohibitions contained therein. Everything in the Bill of Rights also apply to all State, County and City governments.

      The founding fathers did not have cell phones or cameras. In “reality” it is the 2nd Amendment that will keep the rest. The weapons is what allowed all of them to be written down on paper.
      I appreciate Kris Anne, but she is wrong on her “in reality” comment at the beginning. History and common sense proves it.

    The new Army manual, known as ATP 3-39.33, provides discussion and techniques about civil disturbances and crowd control operations that occur in the continental United States (CONUS) and outside the continental United States (OCONUS). In this manual they layout when the Army can use lethal force in crowd control. Its clear in the wording that obstruction Federal or State law is sufficient to use lethal force. On the surface, the Posse Comitatus Act (18 USC 1385) act should prevent the Army from deploying the troops in the midst of a protest that is not on the scale of something like the 1992 LA Riots. However, the Army claims exemption from Posse Comitatus in the four areas.     Hi KrisAnne, I tried sending you an email about this but it bounced back, and I couldn’t think of any other way to get this to you.

    I have been covering a story on Tennessee government corruption which has recently exploded into a huge First Amendment violation issue with national ramifications. A Tennessee trial jury reached a verdict stating that it is now a crime for a citizen to report evidence of crime to his local grand jury if it involves the government and they don’t like what the person has to report.

    CDR Walter Francis Fitzpatrick, III (Ret.), a highly-decorated retired Naval officer of 24 years, is expected to receive several years in state prison for having tried to submit evidence to his county grand jury of criminality on the part of judges, the grand jury foreman, and the sheriff’s department.

    Tennessee courts are so terribly corrupt that one constitutional attorney said four years ago that the situation was “hopeless.”

    If they can do it to one person, they can do it to all of us. Our First Amendment rights are in severe jeopardy.

      Walt was sentenced to 3 years in prison on the 19th. He is currently receiving “diesel therapy” in the prison “system”. This is a form of harassment whereby a prisoner is shuttled around in the system so no one can visit him and he doesn’t know from one day to the next where he is going.
      The sentencing rant by the judge was a travesty. The judge said he was tired of people standing up for their constitutional rights. He said “so what” to Walt’s complaint that grand jury foreman were unlawfully appointed to the position by the judge and served consecutive terms. “So what” and “who cares”?
      This is trampling of the 1st Amendment at its worst and will be used as a model for other jurisdictions when activists attempt to access the grand jury. If Walt’s conviction stands at appeal it will be used as precedent!

    What happens if you protest and simply because of your views, it promotes violence against you or within the community from a certain people or entity because they feel offended and they charge you as a protester with a hate crime and causing a hostile situation endangering the community?

    You left out one of the most important aspects of the 1st. Amendment! The entirety of that “religion” clause was intended to protect the rights of individuals AND STATES to establish and practice as they wished. The phrase “Congress shall make no law” was intended to prevent establishment of a NATIONAL Church which is what drove them from Europe! It was also a prevention of Federal interference with State Churches which then existed in 11 of the 13 States. If we don’t point that out, the lie of “separation of Church and State” is perpetuated. Thomas Jefferson’s often perverted “wall of separation” letter says as much, taken in context. He said, “my office is Federal, therefor I cannot interfere with any religious dispute within a State.” It certainly was not intended to prevent posting the Commandments on State property, or a Manger scene at Christmas. In fact, the 1st. Amendment was written to prevent the Central Government from having ANY voice in such issues!

    Continental United States — definition
    United States territory, including the adjacent territorial waters, located within North America between Canada and Mexico. Also called CONUS.
    Dictionary of Military and Associated Terms. US Department of Defense 2005.

    CONUS or Continental United States is a reference to those geographical locations, which are owned by the federal government i.e. the United States, which are located within the north American Continent. Many of these geographical areas are located within the confines of the American States and are specifically limited geographically. Many military bases are CONUS, the same is true for certain Parks such as Yellowstone National Park. Yellowstone National Park is within Wyoming but the jurisdiction of the federal government is limited to the geographical area of the Park.

    CONUS does not apply to the territory which belongs to the individual States of America. The United States is a fictitious entity which was created by we the People. it is not a geographical location. the United States may own geographical locations but if you go to the UCC you will find that at UCC 9-307(h) The United States is located in the District of Columbia. The reason for this is that the name of the federal Government is “the United States.”

    When reading the Constitution FOR the United States OF America substitute ‘federal government’ for the name ‘United States’ and it will mean the same thing. To wit. A. IV, § 4. The United States shall guarantee to every State in this Union a Republican form of government.

    A. IV § 4. The federal government shall guarantee to every State in this Union a Republican form of government. Says the same thing and means the same thing.

    If there was room enough here I would post a “Brief on Title 4 USC § 72 where it is stated, “All offices attached to the seat of government shall be exercised in the District of Columbia, and not elsewhere, except as otherwise expressly provided by law.” 4 U.S.C. § 72.

    The Brief is 15 pages long but the end result is the fact that when the ‘Jurisdiction’ of the federal government was challanged using the ‘Brief’ the DOJ & the Secretary of the Treasury petitioned the Court for a “Protective Order” which was granted. This is tatamount to ‘silence’ when confronted with the truth. Silence is acquiescence.

    I think you meant to say you have the freedom to petition the government. A redress for grievances would be a settlement of the complaint or grievance.

    This Patriot, this sovereign human being, is RIGHT! We, the People MUST learn, know and use our unalienable rights, those naturally endowed possessions, or those who would be our controllers, those who yearn to be our masters, WILL take them from us. It is up to us to REFUSE to relinquish, REFUSE to acquiesce, REFUSE to give in to the tyranny then back that refusal up with demands that our government employees obey their orders which are spelled out in the Constitution. An invaluable tool for that purpose of demanding compliance and forcing our government employees (whether hired, appointed or elected) to obey our commands is the Common Law Grand Jury. This tool has been cleverly and purposely hidden from us by the very people who it can control, our government employees. Restore the Common Law Grand Jury and we restore Liberty and governmental adherence to the Constitution.     Awesome job explaining this, I also believe that in petitioning your government, you can sign a petition to have someone removed from office as well, if there is enough signatures on the petition demanding the government act on it.

    What she said was great but… Technically, she goes from whispering to yelling and back, which is fine, but it’s difficult to listen to that kind of audio on a computer especially if you have hearing aids.     KrisAnn, I have been a constitutional conservative for over 40 years. I have run for office, I have supported other running for office. I write letters to the editor which our local paper has published weekly for more than 3 years now and I have another paper who has just started publishing my editorials. I use your posts on face book for many of those letters because in the 40 or so years I have been involved, I have met read anyone with a better understanding of our Constitution and who can make it so clearly understood.

    The First Amendment gives us the right to redress the government for grievances. Yet, the how is not stated. We cannot petition the court, we cannot recall our elected officials, so all that is left is the electoral process which is corrupt with corporate and special interest monies. What are we to do?

    First, I need to apologize for mis-spelling KrisAnne’s name in an earlier post. I am truly sorry.
    What KrisAnne is doing is vitally important but she cannot do it by herself. She needs you and me to help her. She can show you the kitchen but she cannot prepare ypou meals and eat food to satisfy your hunger.

    You need to research and dig for the truth and find a remedy for what has happened in America. Something you need to get straight in your mind is the fact that the name of our country is “America.” The name of the federal government is “the United States.”

    Search for a case from 1901, Downes v. Bidwell and read Justice J. Harlans dissenting opinion. He spilled the beans all over the floor with his statements.

    Once you realize that there are two separate Governments created in the Constitution then you will start to understand why the federal government is ignoring us and acting as if they are dictators. Well they are if you and I allow them to do so. Our form of government demands that We the People govern ourselves and we hire (elect) people to speak for us. The problem is that we do not get together and discuss issues and then demand that our employees (Representatives & Senators) do as we command. I can’t do it alone, KrisAnne cant do it alone. We MUST do it together. It is our responsibility and duty to control what goes on in government.

    I-8-17. To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings; — And (a police power implied)

    IV-3- 2. The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States; and nothing in this Constitution shall be so construed as to Prejudice any Claims of the United States, or of any particular State. (police power implied from A.I, § 8, cl. 17)

    • That there is a citizenship of the United States and a citizenship of a state, and the privileges and immunities of one are not the same as the other is well established by the decisions of the courts of this country. The leading cases upon the subjects are those decided by the Supreme Court of the United States and reported in 16 Wall. 36, 21 L. Ed. 394, and known as the Slaughter House Cases. [K. Tashiro v. Jordan, 256 P. 545, 549 (1927)][affirmed 278 U.S. 123 (1928), emphasis added]

    • A person who is a citizen of the United States is necessarily a citizen of the particular state in which he resides. But a person may be a citizen of a particular state and not a citizen of the United States. To hold otherwise would be to deny to the state the highest exercise of its sovereignty, — the right to declare who are its citizens. [State v. Fowler, 41 La. Ann. 380, 6 S. 602 (1889)]

    • I have no doubt that those born in the Territories, or in the District of Columbia, are so far citizens as to entitle them to the protection guaranteed to citizens of the United States in the Constitution, and to the shield of nationality abroad; but it is evident that they have not the political rights which are vested in citizens of the States. They are not constituents of any community in which is vested any sovereign power of government. Their position partakes more of the character of subjects than of citizens. They are subject to the laws of the United States, but have no voice in its management. If they are allowed to make laws, the validity of these laws is derived from the sanction of a Government in which they are not represented. Mere citizenship they may have, but the political rights of citizens they cannot enjoy until they are organized into a State, and admitted into the Union. [People v. De La Guerra, 40 Cal. 311, 342 (1870)]

    Do a search for two cases. BALZAC v. PEOPLE OF PORTO RICO, 258 U.S. 298 (1922) & MOOKINI et al. v. UNITED STATES. You will find out that there are two separate Court systems imbedded in the Constitution. The United States District Court is a Territorial (Administrative) Court & the District Court of The United States is an Article III (Common law) Court, which is the correct court for State citizens. Notice in the footnotes of the Balzac case the citizens of Puerto Rico are granted U.S. citizenship. Puerto Rico is not a State of the Union of States.

    The infringements going on in Ferguson and being “justified” by the lawlessness are going to set dangerous legal precedents –
    You can only protest if you keep walking? You are allowed to protest from “this” time to “that” time?? We will “let you” protest “here”, but not “there”???
    Well, what if “I” want to protest – standing on the corner on the shady side of the street at 5 minutes before the “allotted” time???
    .gov tried this crap in Bunkerville w/ their “First Am Zone” and it was ridiculed, but they’re getting away with it now.
    True, the arrested complainers may get their case(s) thrown out of court down he line, but that didn’t stop the cops from aborting their redress at the time when it matters.
    I MISS AMERICA !!

      There are a lot of things not being displayed on national TV such as all of the initial rioting and looting were people coming in from outside Ferguson. It is unfortunate for the peaceful protesters but the police had the authority and commission to also protect the local people and their businesses. If you disagree then ask a vet just how easy it is to identify the good and the bad in similar instances where we are fighting to keep the peace today. Even though it wasn’t the most popular decision as we found out in hind sight the Ferguson police I feel did what they had to. Hind sight is great, but this was a no win situation from the beginning regardless of how it was handled. Per this link from KrisAnne and how I’ve read it the only thing that didn’t happen was that Ferguson really didn’t have the manpower to protect the local people and they were not proactive enough to be asking for help. But the world is crazy these days and I will agree and I wish we could go back in time but so many are not looking at the entire picture were the business and property owners also have the same rights as the peaceful protesters.

    I just left the msg above and yes I’m the vet in St Louis. A while back they passed an ordinance that protesters had to remain a certain distance from a funeral as we were having a real problem with protesters not being very nice you could say where they were getting in the way and being a real nuance to every funeral relating to a fallen solider. As a vet I was infuriated by their actions but on the other hand that is what we agreed to fight for to keep our freedoms where I can understand why we can’t stop the protesters but was it also wrong to tell them they can protest all they want provided they don’t interfere with the funeral by keeping a distance? Curious to whether that was the right call either (no matter how I thought our fore fathers would’ve thought to protesting our valiant patriots fighting for the protesters freedom to protest)….

    Hello KrisAnne, As a Former Marine and retired Police Officer I want to thank you for making this information available to all. I took an early retirement after 16 years in law enforcement because I was forced, almost daily, to chose between obeying my Oath of Office or just ‘doing my job.’ I truly enjoyed meeting you at the CSPOA convention in Missouri last May (2013) and I found your presentation to be one of the best Constitutional messages I’ve ever heard – and, Yes, I’m one of the 2% who knew all five of the Rights protected by the First Amendment!     Twitter is now creating a database for tracking “misinformation” and Hate Speech on it’s website. While speaking of Hate towards somebody only reflects on what kind of person or life the person leads, Doesn’t this come under the 1st Amendment rights regardless??

    Thank you so very much for the knowledge…. I want to point out that a business in Coeur D’ Alene Idaho, called the Hitching Post, is being persecuted for upholding their christian beliefs and not condoning same sex marriages. The owner is facing fines and up to 180 days incarceration. Your hand out on the first amendment shows that he should be protected by the first amendment, what could the community do to help stand up for this business and the business owner ?     Thank You SO MUCH for preparing the video of our 1st Amendment Rights. I find myself in AWE of your knowledge and expertise. My daughter and I attended one of your 8 hour sessions in St. Charles and I’ve been “hooked” ever since. I plan to share the knowledge of our Constitution with friends and family and hopefully, We, The People, will regain control of our nation, as our Founders intended. God Bless YOU, KrisAnne… I realize the sacrifice you make by spreading the TRUTH about our heritage and our Constitutional RIGHTS as American citizens.     CONGRESS shall make no law … is a specific prohibition on the actions of CONGRESS. It does NOT extend those actions to ANY other government entity,agent or agency. State and local governments REMAIN free to legislate those activities forbidden to CONGRESS by the First Amendment. State and local government can and DO regulate those activities; requiring permits for assemblies, requiring compliance with certain specific laws in order to keep\the peace, zone which prohibit certain speech, etc. Until the late 1800′s some states even had official state religions and remained in compliance with the First Amendment. THAT is as it SHOULD be and how it was designed by the founders; limit the power of the federal government and reserve those functions to the states and the people.

    What a great service you provide. It has become clear, to me, that the largest reason our populace is woefully ignorant of their rights and the way that our country was intended to operate is the destruction of the Swiss based militia system that we were originally organized around. The various civic duties of, and the mandatory service in, the unorganized militia kept people involved in governmental operations. It also ensured that constitutional interpretation was in the school’s curriculum. Had that system been maintained, it would have been nearly impossible for the federal government to become the oppressive dictatorial force we live under today.
    We were incrementally led away from this institution because it was an essential component in the machinery of our country and the key to separating the People from involvement.

    Information on the civic duties of the unorganized militia is not readily available. I have been hard pressed to locate much on the subject but will continue researching, as time allows. Conducting elections when the state (properly) fails to do so, working with and monitoring elected officials to make sure they are following the constitution, implementing alternative currencies, teaching the Constitution in schools, as well as providing many community services are some of the duties meant to be performed by the unorganized militia.

    The more I learn of the unorganized militia, the more aware I become of it’s importance to our society and in the taking back of our country from the clutches of royalty. I would offer the unorganized militia as a subject of instruction in your future endeavors, as my suggestion. I see it as the key to the People regaining and maintaining control of this once great nation. Given the void of facts on the subject; a collection of information on these civic aspects of the unorganized militia would be an invaluable tool in regenerating this necessary component of the intended structure of our country.

    Thank you, Kris Anne, for what you do. You are a beacon of light in a dark sea of ignorance. I am helping in every way that I can and aspire to also become a light guiding the masses in the direction of freedom. Keep up the important work that you do.

    This is something we have needed to be inspired in for a long time. My Mom used to say Christians should not be involved in Politics. Is this why our government has turned away from our own constitution? Only a just and God fearing people can be have true freedom.
